Summary

The Venetian Carnival Association, operating under the brand name “Baronissa,” manages a platform where most of the content is provided by members.

You are responsible for your registration details and everything you publish. You may not publish illegal or harmful content.

The Venetian Carnival Association can review content published by members, but Baronissa is not liable for member-published content.

You agree to receive notifications or emails regarding your profile. You can adjust the notifications you wish to receive at any time in your Settings.

Failure to comply with these terms may result in (temporary) blocking of the services without warning.

Baronissa’s liability is strictly limited.

Consent

The website Baronissa.com and the Venetian Carnival Association applications that can be downloaded (the “Website”) are owned by the Venetian Carnival Association, located in Zwevegem.

By using this Website, you agree to the General Terms and become a full member of the Venetian Carnival Association. Do not use the Website if you do not agree with the General Terms.

Read the Privacy Statement and the Code of Conduct. These General Terms, together with the Privacy Statement and the Code of Conduct, constitute the entire agreement between you and the Venetian Carnival Association (“Agreement”).

Website – Use and Access

The services offered by the Venetian Carnival Association are intended for adults only. You must be at least 18 years old to use the Website. If the legislation in your country requires you to be older than 18 to use this Website, the minimum age of that legislation applies.

You must provide correct, truthful, and non-misleading information about yourself. Update your information when it changes. You declare that the information you publish does not infringe upon the rights of any third parties.

Membership

You gain access to the services and become a member of the Website by creating a profile on the Website. No one may register more than once, even if using a different name. Membership is personal and cannot be transferred to third parties.

The Venetian Carnival Association has the right to refuse any membership application. Your membership only begins after receiving a confirmation email from Baronissa.com.

You can terminate your Baronissa membership at any time through your Settings.

Neither termination by you nor termination by us entitles you to any compensation.

The Venetian Carnival Association may terminate or suspend your membership at any time if you violate the General Terms or if there is a risk that you may violate the General Terms. Such termination or suspension may be performed without warning. However, you will always receive a subsequent notification from us. After such termination or suspension, you cannot register again or use our services unless you are notified that the suspension has been lifted.

You acknowledge and agree that the termination of your membership, for any reason, means that the content you added to Baronissa.com will be partially or completely removed.

Member Obligations

Any use of the Website must comply with applicable laws. You may not use the Website if applicable laws prohibit you from doing so.

The Venetian Carnival Association may disclose your information to the relevant authorities without prior warning if you violate the law. You can learn more about how we handle your data in our Privacy Statement.

You may not use this Website to sell goods or services or distribute promotional materials without prior explicit permission from Baronissa.

You must comply with the Code of Conduct when using the Website.

Data Published by Members

On Baronissa.com, you can meet new people, chat, and share photos. Keeping Baronissa.com safe and fun is as important to us as it is to you.

You are responsible for all texts, photos, and other information you publish on Baronissa.com.

In particular:

You may not publish insults, obscene material, or any other material that undermines human dignity.

You may not harm other visitors to the Website by installing computer viruses or other malware.

You may not publish misleading, defamatory, threatening, or offensive material.

You may not stalk other members or try to convince them of your political or religious beliefs. Excessive use of nationalist or religious symbols will not be tolerated.

You may not steal someone’s identity. You maintain your own identity in all your publications.

You may not publish illegal material or material that incites crimes. Photos with weapons are not allowed.

You may not publish material that infringes on the intellectual property or portrait rights of others. This means you may not copy material or photos of others without their explicit permission.

This is the Dutch version of Baronissa.com. To enable communication and moderation, you may only use Dutch. This rule does not apply to quotations, poems, song lyrics, or jokes.

Be cautious!

The Website may contain material that you find inappropriate.

The Venetian Carnival Association has the right, but not the obligation, to monitor members and the material they publish on the Website. The Venetian Carnival Association may intervene in disputes between members.

The Venetian Carnival Association has the right to remove any material from the Website if it violates the General Terms or if the material is harmful to a third party.

Safety

Publication of confidential or sensitive material is done at your own risk.

The use of logins, passwords, and/or other access codes (hereinafter referred to as login details) is entirely the responsibility of the user “members.” The user must keep their login details confidential and secure. The user must immediately notify Baronissa if their login details are misused by sending an email to abuse-info@Baronissa.com.

You agree to take reasonable precautions in your interactions with other members, especially if you decide to meet other members offline. Read the Code of Conduct before using the Website.

Unwanted and illegal material on Baronissa.com should be reported as soon as possible using the ‘Report Abuse’ button. If your complaint is valid, the Venetian Carnival Association will remove all inappropriate material (text, images, information, data) as soon as possible. Illegal activities may be reported to the authorities.

Notifications and service messages

You agree that the Venetian Carnival Association may send you important notifications on the website, mobile apps, or via email.

Your contact information must be accurate to receive important notifications. For service messages or notifications about the service, the Venetian Carnival Association may also place a banner on the site to inform you of certain changes, such as changes to this Agreement.

The Venetian Carnival Association may also notify you by sending an email to an email address linked to your account. You also agree that the Venetian Carnival Association may contact you through your Baronissa.com account or other means, including email, mobile number, or phone, in connection with your Baronissa.com account or services related to the Venetian Carnival Association.

Check your Settings to see which messages you receive from Baronissa.com. You agree that we shall have no liability in relation to or as a result of your failure to provide correct contact or other information, including but not limited to not receiving important information.

Liability

The Website is a platform where members can publish information about themselves and connect with other members. The Venetian Carnival Association does not arrange meetings, relationships, or provide relationship advice. The infrastructure of the Website is provided by the Venetian Carnival Association, but the material on the Website is largely published by members. The Venetian Carnival Association cannot be held responsible for any behavior of its members or if the Website does not meet certain expectations. Baronissa does not provide any explicit or implied warranty regarding the reliability, security, or continuity of this service.

The Venetian Carnival Association has no control over the quality, compatibility, or safety of its members, or over the truthfulness, accuracy, or completeness of publications on the Website. You are aware that, despite the prohibitions in these Terms and Conditions, material on the Website may be incorrect or deceptive.

The Venetian Carnival Association takes all reasonable measures to ensure that the Website is operational and free from bugs. However, the nature of the internet and software does not allow for continuous and error-free operation.

The Venetian Carnival Association can never be held liable for indirect or direct harmful consequences of your behavior or the behavior of others on the Website, including (but not limited to) emotional harm, loss of opportunities, loss of data, loss of time, or any other damages resulting from communication or encounters with members you meet through the Website.

The above disclaimers and limitations of liability do not apply in case of fraud or gross or willful negligence towards the Venetian Carnival Association. Where permitted by applicable law, liability for bodily injury and death is also excluded.

You agree to indemnify us against all claims by third parties (including legal costs) arising out of or related to your use of the Website, information and/or material published by you on the Website, and/or any form of breach of contract.

Intellectual Property Rights

You guarantee that the information on your profile has been published by you and that you are the sole author on that profile. You grant the Venetian Carnival Association an unrestricted right to use, process, translate, or modify data that you shared with other members via the Baronissa.com Website, including but not limited to text, photos, images, drawings, photo descriptions, etc.

Trademarks, logos, images, photos, animations, videos, and text on https://www.Baronissa.com are the intellectual property of the Venetian Carnival Association and may not be reproduced, used, published, distributed, sold, or displayed without the explicit, prior, and written permission of Baronissa.

Event Cancellation by the Venetian Carnival Association

The organizer (Venetian Carnival Association) reserves the right to cancel an event due to a low number of participants or other circumstances that would make the event non-viable. If this occurs, all registrants will be refunded their registration fee. If the cancellation circumstances are such that the event will take place on a later date, the organization has the right to either provide a full refund or move the registrations to that later, new date.

Jurisdiction and Applicable Law

This agreement is governed by Belgian law, without regard to its conflict of laws principles. In the event of a dispute regarding the use of the Website or this agreement, the Courts and Tribunals in the Leuven area, Belgium, shall have jurisdiction, unless otherwise determined by applicable consumer law.

The Venetian Carnival Association may amend these terms at any time. Amended versions shall become effective thirty (30) days after publication on the Website. By continuing to use the Website after the changes, you implicitly accept the amended version. If the changes have a negative effect on a paid service, you have the right to terminate that service and receive a pro rata refund, provided you notify us within the aforementioned 30-day period.
